    MAPPING THE INFORMATION ENVIRONMENT: LEGAL ASPECTS OF MODULARIZATION AND DIGITALIZATION

    The Article highlights the language of the digital and the principle of modularization as the basic concepts which the further development of the information environment will have to pivot around, regardless of how conflicts between freedom and control are temporarily solved. Perceiving both the computer and the Internet as complex systems, the authors look at how modular design of these systems freed the functionality of applications from the physicality of infrastructures, describe the evolutionary gains adhering to modularity, and how to preserve them - elaborating on the issues of access to the cable platform for broadband Internet and to virtual networks for computer technology. Their second focus shows how digitalization of information makes possible the merger of content and its protection. Especially through the use of DRM systems, private actors can create right enforcement mechanisms independent of the State. The legal system therefore faces new and more complex relations between private will and public sovereignty. In such a merged system it is harder to maintain freedom - much like in the fusion of function and infrastructure

    The present paper investigates the interference between copyright and freedom of expression in the European Union. In particular it (i) shows that the Court of Justice has substantially avoided to balance those rights, while a significant space remains for an interpretative fine tuning in this field; (ii) analyses the meaning of freedom of expression and recognizes how it \uabpermanently interferes\ubb with copyright; (iii) argues that the balance between these fundamental rights could be undertaken by the Court beyond the breathing spaces provided by specific intellectual property clauses containing exceptions or limitations; (iv) suggests that such balancing should be pursued by selecting solutions not meant to maximize third interests but to minimize both rights\u2019 sacrifices

    Il presente lavoro elabora una proposta di ricostruzione critica dei diversi paradigmi della disciplina giuridica delle decisioni algoritmiche. Questa prospettiva organica consente di identificare i criteri interpretativi necessari per l’applicazione delle regole esistenti e di individuare quali siano i possibili ambiti di interventi normativi o di iniziative spontanee degli operatori. Le soluzioni analizzate emergono da ambiti differenti: da sistemi di regole specificamente rivolte all’intelligenza artificiale, da discipline che affrontano questi temi solo marginalmente o implicitamente, da sistemi di norme consolidate e non destinate, originariamente, a questo ambito. Gli esiti della ricerca mostreranno che la decisione algoritmica Ăš un fenomeno giĂ  ampiamente regolato dal diritto ben oltre quanto espressamente rivolto all’esplicita regolazione dell’intelligenza artificiale; l’impegno del giurista in questo ambito puĂČ certamente spingersi verso frontiere d’indagine estremamente affascinanti ma puĂČ anche rivolgersi alla elaborazione di proposte di lettura organiche in una materia che rischia di rimanere in balia della disarticolazione normativa; l’interpretazione teleologica e la valutazione degli interessi costituiscono utili strumenti per tentare proposte di costruzione analitica della materia e soluzioni applicative.The present work provides a critical reading of different legal paradigms concerning algorithmic decisions. Indeed, through such a systematic perspective we can better identify interpretative solutions to existing legal rules by envisioning which areas deserve further regulatory intervention or private based initiatives. The several rules seen here belong to different legal layers: some are specifically designed for artificial intelligence or partially involved in the topic; while others were raised well before the advent of AI society. The overall work demonstrates that the algorithmic phenomenon is already extensively regulated well beyond the EU Proposal for a Regulation on AI. This field of research may significantly benefit from systematic analyses provided by scholarly research and teleological interpretation may become a pivotal tool to unveil a conceptual structure over disarticulated laws
